Have we given up our right to go on strike if necessary? Airline workers are governed by the Railway Labor Act (RLA) which contains a series of steps that must be followed before employees can go on strike or management can lock them out. Under the “No Strike/No Lockout” requirements of this Agreement, both sides must go through the processes of the RLA until they are released for “self-help” by the NMB where they employees are allowed to strike and companies are allowed to lock-out. Under this Agreement, FSI Flight Attendants would be allowed to do any kind of legal protest providing it did not impact Company operations.

Under this Agreement, “Job Actions” (strikes) on Department of Defense (DOD) charters are not allowed by Federal Law. FSI Flight Attendants would have the right to legally strike on any other passenger or cargo service. In the case that a legal job action is planned, FSI would have to provide the Union with written documentation of charter flights being operated under the DOD.

A good example of this is that in 2005, when FMLA law was changed to require a lower threshold of 504 hours for Flight Attendants, that was automatically adjusted and the remainder of the contract remained in place and continued protecting Flight Attendants.
